1. Introduction and who we are
Welcome to AgriCrete.com (“the Site”), owned and operated by C. Darell & Assoc. Inc., operating under the name AgriCrete (“we,” “us,” or “our”). We are committed to protecting your personal information and your right to privacy.
For the purposes of applicable data protection law, C. Darell & Assoc. Inc. is the controller responsible for the personal information described in this Privacy Policy. You can reach us using the details in Section 13 (Contact us).
2. Information we collect
We collect the following personal information:
- Names
- Email addresses
- Phone numbers
- Company names and, if you choose to provide it, your address
- The content of any message you send us
- IP address and basic technical information (browser type, device type, pages visited, referring page) collected automatically through our analytics tool
3. How we collect information
We collect information directly from you when you:
- Fill out and submit forms on our website, such as the contact form.
- Communicate with us via email or phone.
We also collect information automatically through the technologies described in Section 9 (Cookies and tracking technologies), including our analytics provider, Umami, and, where you load it, Google Maps.
4. Purpose and legal basis for processing
We use the personal information described above for the following purposes and on the following legal bases:
- To respond to your enquiry and communicate with you, including through our contact form — necessary for steps you request before entering into a contract, or for our legitimate interest in responding to enquiries addressed to us.
- To protect the Site and our contact form against spam and abuse, using reCAPTCHA and automated spam filtering — our legitimate interest in the security and integrity of our services.
- To understand website usage and improve our services, using privacy-preserving analytics — our legitimate interest in understanding and improving the Site, balanced against your interests as described in Section 9.
- To show a location map or address-lookup suggestions where you choose to load them — your consent, given by clicking to load the relevant feature.
- To comply with our legal obligations, for example responding to lawful requests from public authorities.
Providing your name, email address and message is necessary for us to respond to your enquiry; if you do not provide it, we will not be able to reply. All other fields on the contact form are optional.
We do not carry out automated decision-making or profiling that produces legal or similarly significant effects on you.
5. Data sharing and recipients
We do not sell your personal information. We share it only with the following categories of recipients, each acting as our processor or, for Google’s services, as an independent controller of the data its service collects:
- Resend, our email-delivery provider, to send us your contact-form submission by email.
- Google, for reCAPTCHA (bot protection on the contact form) and, where you choose to load them, Google Maps and address autocomplete. See Section 9 for details and Google’s own privacy policy.
- Our hosting provider, to operate the Site and deliver these pages to you.
- Professional advisers, auditors or authorities, where required by law or to establish, exercise or defend legal claims.
6. International data transfers
C. Darell & Assoc. Inc. is a Canadian company. The Canadian federal government has been recognized by the European Commission and the UK government as providing an adequate level of data protection for personal data transferred from the EEA and the UK to organizations subject to Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA), which allows such transfers to take place without additional safeguards.
Some of our service providers (Section 5) are based in, or process data in, the United States. Where that is the case, the transfer is made under a mechanism recognized by applicable law, such as the EU-U.S. or UK-U.S. Data Privacy Framework or standard contractual clauses. Contact us using the details in Section 13 for more information about these safeguards.
7. Data retention
We keep personal information only for as long as necessary for the purposes described in this Privacy Policy:
- Contact-form and enquiry data: up to 24 months after your last contact with us, unless a longer period is needed to pursue the enquiry, respond to a legal claim, or a customer or distributor relationship continues.
- Server and security logs generated by handling your request: a short operational period, typically no more than 30 days, used only to operate and secure the Site.
- Analytics data: retained by Umami as described in Section 9, and never includes cookies or persistent identifiers.
When information is no longer needed for these purposes, we delete it or anonymize it so it can no longer identify you.
8. Data storage and security
- We implement appropriate technical and organizational measures to protect your information from unauthorized access, alteration, disclosure or destruction, including transport encryption (HTTPS), input sanitization, and rate-limited, bot-protected form submission.
- No method of transmission or storage is 100% secure, and we cannot guarantee absolute security.
9. Cookies and tracking technologies
Our analytics provider, Umami, does not use cookies and does not collect data that identifies you individually. Umami records aggregate visit statistics (such as page views and referring pages) and, to help us understand how visitors use the Site, an aggregated view of on-page interactions such as clicks, taps and scrolling. This does not include anything you type into a form field. This data is processed on infrastructure we control and is not shared with or sold to third parties.
When you submit our contact form, your browser is given a single strictly-necessary security cookie (to prevent cross-site request forgery). This cookie does not track you across the Site or across other websites, expires within one hour, and is not used for analytics or advertising.
If you choose to load an embedded Google Map (for example on our distributors page), or if the address-lookup feature on our contact form is available to you, Google may set its own cookies and process your IP address and interactions with that feature under Google’s privacy policy. We only load these Google features after you click to enable them, or, for reCAPTCHA, in order to protect the contact form from automated abuse.
Your browser may also store small amounts of information on your own device (using localStorage or sessionStorage) to remember non-essential preferences, such as whether you dismissed our language-suggestion popup or whether you chose to load an embedded map. This information stays on your device, is not sent to us, and can be cleared at any time from your browser settings.
When you choose a language, we store one strictly necessary language-preference cookie (lang_pref, kept for one year) so the Site keeps showing that language. To show the Site in your language automatically, we use your browser’s language setting and your approximate country (as provided by our hosting or content delivery provider, if available), without storing either.
10. reCAPTCHA
Our contact form is protected by Google reCAPTCHA to prevent spam and abuse. reCAPTCHA collects hardware and software information, such as device and application data, and sends it to Google for analysis. This is subject to Google’s Privacy Policy and Terms of Service.
11. Children’s privacy
Our website is intended for professionals and businesses. We do not knowingly collect personal information from children, and if we become aware that we have inadvertently collected personal information from a child, we will delete it.
12. Your rights
Depending on where you live, you may have some or all of the following rights regarding your personal information: to access the information we hold about you; to request correction of inaccurate information; to request erasure; to restrict or object to our processing, including processing based on our legitimate interests; to request a portable copy of information you provided to us; and to withdraw consent at any time where processing is based on consent, without affecting the lawfulness of processing before withdrawal.
- Opt-out: You may opt out of receiving marketing emails at any time by following the unsubscribe instructions in the emails or by contacting us directly.
- Access, correction, deletion and other rights requests: contact us at [email protected].
- EU/EEA residents: you also have the right to lodge a complaint with your local data protection supervisory authority, or with the supervisory authority of the EU member state where the alleged infringement occurred.
- UK residents: you have the right to lodge a complaint with the Information Commissioner’s Office (ICO) at ico.org.uk.
- UAE residents: you have the right to lodge a complaint with the UAE Data Office.
We will respond to verified requests within the time required by applicable law. We may need to verify your identity before acting on a request.
